ZoomieFitness – Terms of Use & Privacy Policy

Thank you for using ZoomieFitness ("ZoomieFitness", "we", "us", or "our"). These Terms of Use and Privacy Policy (together, this "Agreement") govern your access to and use of our mobile app, website, and related services (collectively, the "Service"). By creating an account, booking a session, or using the Service in any way, you agree to this Agreement. If you do not agree, please do not use the Service.

1. Who We Are

ZoomieFitness provides safe, structured slatmill runs and conditioning sessions for dogs, delivered from our mobile van. We use the Service to book and manage appointments, track sessions, performance, and conditioning data, and help keep dogs, staff, and equipment safe. The Service is intended for dog owners ("pet parents") and, where applicable, our staff members using internal tools.

2. Eligibility & Accounts

  • You must be at least 18 years old to create an account and use the Service.
  • You are responsible for keeping your login details secure and for activity under your account.
  • You agree that the information you provide is accurate and kept up to date, including your contact information and your dog's profile details as reasonably possible.

We may suspend or terminate your account if you violate this Agreement or misuse the Service.

3. Use of the Service

You agree to use the Service only for lawful purposes. You agree not to:

  • Use the Service to plan, promote, or support illegal activities, including animal cruelty.
  • Harass, threaten, or abuse any person or animal.
  • Attempt to access data or systems you are not authorized to access.
  • Interfere with or disrupt the Service or our infrastructure.

We may monitor usage patterns and log certain actions to maintain safety, investigate issues, and improve operations.

4. Booking, Payments & Cancellations

Pricing, travel fees, and any discounts are displayed in the app or on our website. Cancellations and rescheduling follow our published policy (for example: free beyond a certain time window, partial charges for late cancellation, etc.). Promotions or discounts may have specific conditions and expiration dates.

Payment processing may be handled by a third-party provider (such as Stripe). Their terms and privacy practices apply in addition to this Agreement.

5. Health & Safety Disclaimer

We take safety seriously, but you understand and agree that:

  • You are responsible for informing us of your dog's health history, medical conditions, and any vet guidance you have received.
  • We may require vet clearances, medical documents, or special notes before or after certain sessions, particularly when there are medical flags or concerns.
  • We may refuse or stop a session if we believe a dog may be at risk or unsafe to continue.

We do not provide veterinary care or medical diagnoses. Our services and any information we provide are not a substitute for professional veterinary advice. Always consult your veterinarian about your dog's health and exercise limits.

6. Changes, Availability & Termination

We may change or update the Service from time to time, including adding, removing, or modifying features. We may also suspend or end all or part of the Service if needed for maintenance, security, legal, or business reasons.

You can stop using the Service at any time. We may terminate or suspend your account if you violate this Agreement, if we suspect misuse, fraud, or security risks, or if we are required to do so by law.

7. Intellectual Property

All content and materials in the Service (excluding your content and data) are owned by us or our licensors, including software, code, designs, text, graphics, icons, and logos. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal (or, for staff, internal work) purposes, subject to this Agreement.

You may not copy, modify, reverse-engineer, or redistribute our software, branding, or content without our written permission.

8. Your Content

You may provide content and information through the Service, including dog profiles and photos, appointment details, uploaded vet or medical documents, feedback, and other communications. You remain the owner of your content.

By uploading or submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content as needed to provide and improve the Service, meet legal obligations, and maintain safety.

You represent that you have the right to share any content you upload and that it does not violate the rights of others.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free, that all health or behavior issues will be detected or prevented, or specific fitness results or outcomes for any dog.

To the maximum extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claims arising out of or related to the Service or this Agreement will not exceed the amount you paid to us for services in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

10. Privacy Policy

This section explains how we collect, use, and protect your information when you use ZoomieFitness.

10.1 Information We Collect

We only collect information you choose to share with us or that is generated by your use of the Service. This includes:

  • Account information: name, email address, phone number, password (stored securely), and optional profile details.
  • Addresses: home or service address, ZIP code, and (where needed) approximate location data for booking and routing appointments.
  • Pet information: dog name, breed or mix, age, gender, notes on behavior, and any information you choose to add.
  • Health and safety information: medical flags, health notes you enter, and vet or medical documents you upload (for example, clearance letters or test results).
  • Appointment & usage data: session history, locations, and conditioning stats where available, as well as communication history and support interactions.

For staff who log into our tools, we may also collect basic staff profile information, shift and time data, and vehicle safety check data (including odometer readings and photos, exterior/interior photos, and NFC tag scans for assigned vehicles or equipment).

When you use the app or website, we may also receive technical information, such as device type, operating system, app version, IP address, and basic usage analytics to help us operate and improve the Service. We do not access your camera roll, photos, or files without your explicit choice to upload or capture something.

10.2 How We Use Your Information

  • To provide and operate the Service and manage your ZoomieFitness account.
  • To book, modify, and manage appointments, and to power in-app features like pet profiles and appointment timelines.
  • To support safety and medical screening, including reviewing medical flags and uploaded vet documents and determining whether a dog appears safe to run a session.
  • To document and review staff safety checks, incidents, and equipment condition.
  • To communicate with you, including appointment confirmations, reminders, updates, post-session summaries, and responses to support requests.
  • To improve and secure the Service, debug issues, and prevent abuse or misuse.
  • To comply with legal obligations and enforce our rights.

We do not sell your personal information or use your data for third-party advertising.

10.3 AI and Automated Analysis

For certain health and safety workflows (for example, vet clearances and medical flag review), we may use AI-assisted tools to extract relevant information from uploaded documents and suggest flags or summaries to staff for human review. Any AI outputs are used as support tools and not as a replacement for human judgment or veterinary care.

10.4 Sharing Your Information

We may share your information with service providers and processors who help us run the Service (for example, hosting providers, payment processors, secure storage, analytics tools, and AI providers). These parties are only allowed to use your data to provide services to us and must protect it appropriately.

We may share relevant data with our staff and internal team members who need access for operations, safety checks, incident review, and customer support. We may share data with vets, trainers, or other third parties only when you explicitly ask us to share certain reports or data. We may also share information with law enforcement or authorities if we reasonably believe it is required by law or needed to prevent harm, cruelty, or serious misconduct.

We do not sell your personal data or share it with third parties for their own marketing.

10.5 Data Retention & Security

We keep your information only as long as reasonably necessary to provide the Service, maintain accurate records of sessions, health notes, and safety checks, comply with legal and tax requirements, and resolve disputes and enforce our agreements. Where feasible, we may de-identify or aggregate data so it can no longer be linked to you or your pets.

We use reasonable technical and organizational measures to protect your information, such as encryption in transit, access controls, and audit logs for sensitive actions. No system is 100% secure, and we cannot guarantee absolute security.

10.6 Your Choices & Rights

Depending on your location, you may have rights to access, correct, or delete certain personal data, to object to or restrict certain processing, or to request a copy of certain data in a portable format. To make a request, contact us using your usual ZoomieFitness support channel. We may need to verify your identity before fulfilling your request.

11. Changes to This Agreement

We may update these Terms and this Privacy Policy from time to time. If we make material changes, we will update the "Last updated" date at the top and take reasonable steps to notify you, such as in-app notices or email. Your continued use of the Service after the changes take effect means you accept the updated Agreement.
